I don’t think anyone will argue that they feel horrible for seniors. 
 

however, this should be a call for the parents in that program to have the entire board and coach to resign and never hold a post again. They are the sole reason for this. Sad parents ruined it for kids.

Fire the volunteers!!!  Off with their heads!  Suspend the program for 2 years!!!  Punish the kids even more than you did!!!   Teach them a lesson!!!  Did you people even read the summation from the judge?  Or can you not comprehend?  Brilliant solution.  If the entire board resigns, there is no program.  Nobody wants to do it but those who volunteer.  So much hate to the volunteers it’s moronic.

Hey, if Montour doesn't have a team, another school can pick these players up. Then these nasty people on this forum can find shark bait somewhere else. JMO. Isn't that how you folks say it?

This is absolutely not what the judge said. What the judge actually said was that he found Montour's arguments compelling, and that the ambiguity in the rules is also troubling to him. However, he noted that in order to issue an injunction there would have to evidence that irreparable harm would come to Montour, and that Pennsylvania case law has found that a loss of opportunity to play in a potential playoff season does not constitute irreparable harm. Because Montour was unable to show that irreparable harm would result from the situation due to the case law, the judge could not issue the requested injunction.

Note though the first part - the judge did say that he found Montour's arguments for why they believed the player was eligible to play credible. Paragraph 1 says (in part) "the innocent and highly successful Montour Hockey Team". That doesn't sound like the comment of a man who thinks Montour would fail in court on the facts. He also notes that he wasn't commenting on the other prerequisites for issuing an injunction because case law is clear on the question of irreparable harm in this situation and further analysis is not required (this is common in these cases - because you have to show irreparable harm to get an injunction, judges often use that as the first test and stop their review if irreparable harm cannot be demonstrated). I'm thinking the judge here believes that Montour would win this issue in court, but he cannot order an injunction.

My take is that PIHL needs to overhaul their rules regarding transfer students completely, and also needs to take a lesson on due diligence here. PIHL should be able to rely on organizations to fill their paperwork out completely and correctly, but the issues with ambiguity in the letter of the rules are undeniable, even if it is reasonably clear what the intent of the rules is. As I said before, it's not hard to imagine this happening with everyone acting in good faith, and misunderstanding the rules. It's clear, at least now, what PIHL intended when they wrote that rule, but the rule itself is fuzzy as written.

Thanks for the summary!  Well done. Saves a lot of time trying to go back and read the Judges opinion.  Bottom line is that Montour could still win but it is a dead issue once the playoffs start and finish.  Hopefully all Western Pa High School Hockey programs learned from this.  tough way for Montour to end the season!

Montour got caught cheating 3 times this year. Stop blaming everyone except for who is to blame and that is your coach. So what if BB turned your kid in, he followed the rules. If you don't like it fire your coach or the team manager that filed the paperwork. You are mad at someone that did what was right and not mad at the person that did something wrong ???. Do you hear yourself?

Not sure how this situation benefited QV. They did beat Indiana, but if they had been the fifth seed, they would’ve played Kiski, who Indiana just beat last week. And now Quaker Valley has to go on the road and play Fox Chapel, rather than  play North Hills on the ice surface where Quaker Valley practices twice a week.

Ohh then you'll run and sue casue you dont like the answer - how did that work for you?? - everyone else has to follow the rules but Mighy Mountour - because they'll sue if the dont get what they want , maybe thats worse than your so called"snitching" - but if you would have only gotten away with it huh.
